Artek x Design Hotels

Terms & Conditions of the competition

Entrants participate by following Design Hotels and Artek on Instagram, liking the gallery post on the Design Hotels or Artek account, and tagging a friend in the comments under the “Artek x Design Hotels Giveaway” gallery post on the Design Hotels or Artek account. Design Hotels and Artek will combine entries from both accounts and choose one winner at random.

1. The prize of this competition is a set of two Artek x Design Hotels Stool 60. These will be shipped to one address. The winner will pass the stool to their friend by their own means.

2. The competition is organized by Design Hotels GmbH (“Design Hotels™”), Stralauer Allee 2c, 10245 Berlin and runs from 10 November 2021 (08:00 am CEST) until 17 November 2021 (11:59 pm CEST) (the “Entry Period”).

3. Design Hotels™ reserves the right to cancel the competition at any time without prior notice. In particular, but not limited to, Design Hotels™ may cancel the competition in case of technical issues (e.g. computer viruses, manipulation or hard/software errors), or if, due to legal reasons, the competition cannot be properly implemented. Should a participant be cause for the cancellation of the competition, Design Hotels™ may demand compensation for damage.

4. Participants must be 18 or over. Participation is excluded for employees and freelancers working for Design Hotels GmbH, its subsidiaries, affiliates and local partners and their respective immediate family and household members. Only one entry per person is permitted. Entries generated by script, macro, or other automated means are void. Design Hotels™ reserves the right, in its sole discretion, to exclude persons who attempt to manipulate the competition in any way whatsoever, who violate these terms and conditions of participation or who deliberately misuse the competition to annoy, insult, threaten or harass persons.

5. Prizes are not transferable and cannot be redeemed for cash.

6. The winning entry will be chosen at random the day after the Entry Period ends. Winner will be notified via Instagram. Winner must claim their prize within five business days from the time of the notification or will forfeit such Prize, whereupon another winner may be selected from the pool of eligible entries. All decisions or judgments by Design Hotels™ in this Giveaway are final.

7. In the event of unforeseen circumstances, Design Hotels™reserves the right (a) to substitute an alternative prize of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice.

8. Winner is responsible for any tax payable as a direct or indirect result of the competition. Design Hotels™ is not in any way liable for any tax payable by the winner. We pay shipping of both stools to 1 address, so there shouldn’t be any extra costs. Ok, I took out the part on transportation costs and left this in.

9. The winner will be informed via Instagram about their prize and must confirm acceptance of the prize within five business days.

10. Except where prohibited, participation in the competition constitutes each winner’s consent to competition partners’ and their agents’ use of the winner’s names for promotional purposes in any media without further payment or consideration.

11. Entries via agents or third parties are invalid.

12. The Design Hotels™ is only liable for damages if the damage is due to intent or gross negligence of the Design Hotels™. The Design Hotels™ is liable for culpable injury to life, body or health of a person even in cases of simple negligence. In addition, the Design Hotels™ is also liable for the simple negligent violation of an essential contractual obligation. A contractual obligation is essential if its fulfilment makes the proper execution of the contract and the fulfilment of the purpose of this contract possible in the first place and on whose fulfilment a Giveaway participant may regularly rely. Liability under the Product Liability Act remains unaffected.

13. The competition is subject to German law.

14. When storing and using the participants’ data, Design Hotels™ will comply with the relevant data protection regulations. Design Hotels™ will collect, store and use the personal data provided for the purpose of participation in the competition. The data will only be stored for as long as it is required for the aforementioned purposes. No data will be passed on to third parties, unless the passing on is necessary for the execution of the competition or the sending of the prize (e.g. postal service provider etc.). 15. There are no legal remedies to review the draw of the winner. The competition is in no way hosted, supported, endorsed or conducted by Facebook Ireland Limited or other Facebook companies (“Facebook”) and is unrelated to these. Participation in the competition does not give rise to any claims of the participants (in particular no liability claims) against Facebook with regard to the competition. Any invalidity or unenforceability of certain clauses of these Terms & Conditions of participation shall not affect the validity or enforceability of other clauses.

16. Legal recourse is excluded. 

17. The participant indemnifies Design Hotels™ against claims of third parties of any kind whatsoever resulting from the illegal use of photos or other content used by the participant. The indemnity obligation also includes the obligation to fully indemnify Design Hotels™ from legal defense costs (e.g. court and lawyer fees). 

18. These Terms & Conditions shall be governed by German law to the exclusion of the German conflict of laws provisions and the UN Convention on Contracts for the International Sale of Goods.
